Abstract:
This paper analyzed the research status of national park legislation in China and the enlightenment of international experiences on national park legislation and system construction in China. Based on the current legislative limitations of national parks and the local pilot practice, the realistic legislative requirements of national parks under the goal of “establishing a natural protected area system with national parks as the main body” were drawn out. At the same time, this paper put forward a multi-level legislative approach to establishing the national park law at the national level, formulating the implementation rules of the national park law at the local level according to their respective conditions, and drawing up the specific planning of national parks by the national park authorities. In addition, the relationship between national park legislation and natural protected area legislation should be analyzed scientifically, and the influence of national park legislation on the systematization of natural protected area legislation should be carefully handled. In response to the rule of law, China should take the operable national park law as the first step to establish a set of systems and mechanisms suitable for the construction and management of national parks. Also, we should give full play to the pioneering exploration significance of the National Park Law, take the holistic thinking as the guidance, and proceed from the overall situation of constructing the legal system of natural protected areas to formulate a common principle mechanism to provide a legislative example for the natural protected areas law in the future.
